House Bill (HB) 2138: municipalities; right-of-way; transfer

Overview: HB 2138 allows a county roadway or right-of-way to be transferred by mutual consent of the county and city governing bodies.

League Position: SUPPORT - This bill facilitates the transfer of right-of-way without having to go through the annexation process.

Summary: Under current law, a municipality can acquire right-of-way from a county through the annexation process if the annexation is agreed to by the respective governing bodies. This bill maintains the mutual consent requirement, but it allows for the transfer without having to annex the roadway.
