Senate Bill (SB) 1278: homeowners' associations; public roadways

Overview: SB 1278 prohibits the association of a planned community for which the declaration is recorded after December 31, 2014 from regulating a roadway that is dedicated to or held by a governmental entity.

League Position: OPPOSE - The League believes this bill is an encroachment on local authority and will increase the burden on municipal resources.

Summary: This bill would require cities and towns to take over the regulation of roads within planned communities whose declaration is recorded after December 31, 2014, if the roads are dedicated to or held by the city or town.
