Budget Work Pending

The Legislature is expected to stop all committee hearings next week to enable legislators to work on the FY 2010 and the FY 2011 budgets.

The Senate has already stated committee hearings will be suspended for the week, yet floor activity will continue. The League is anticipating the House to follow suit.

Eminent Domain: Fact Sheet

Over the last several years, the Arizona State Legislature has developed a pattern of attacking eminent domain statutes.

Eminent Domain is the power of a governmental entity to take private property for public purposes, with or without the permission of the owner. The US and Arizona Constitutions require "just compensation" for any property taken using eminent domain, and the Arizona Constitution and statutes spell out in detail the purposes for which eminent domain may be used and the process for implementing it.

SB1398 federal regulations, local coordination

This bill, sponsored by Senator Sylvia Allen (R-Snowflake), enables local governments to demand the federal government coordinate with the municipality before enforcing federal mandates. Senator Allen's inspiration for this bill stems from the impact federal legislation such as the National Forest Management Act, the Endangered Species Act, the Clean Air Act and more have had on local governments.

Alternative Procurement Delivery Method Bill Passes Senate Committee

SB1406: procurement; construction; specialized services, passed the Senate Natural Resources, Infrastructure and Public Debt Committee during the week. This lengthy bill makes a number of changes to the statutes governing Alternative Procurement Delivery Method (APDM).

HB2515 confidential tax information, utilities

The House Ways and Means Committee adopted a strike-everything amendment to HB2515: confidential tax information; utilities, that could have serious repercussions on transaction privilege tax (TPT) collections for cities and towns. The bill and the striker were sponsored by Representative Rick Murphy (R-Glendale).

On Wednesday the House Military Affairs and Public Safety Committee (MAPS) passed House Bill 2632: immigration; law enforcement; safe neighborhoods, by a vote of 5-2, with one legislator voting "present."

Session Update

This was the final week to hold committee hearings on bills in their house of origin. As a result, activity in committee and on the floor was abundant, with much of the action affecting municipalities. The final tally for bills introduced is 1,232 with 153 memorials and resolutions. It is now important for the League to track amendments and strike-everything vehicles.

HB2504 GPLET, lease records and reporting

As we mentioned in previous Bulletin articles, lawmakers want to address issues with the Government Property Lease Excise Tax (GPLET) again this session. Representative Rick Murphy (R-Glendale) has been hosting stakeholder meetings about various GPLET issues, including the rate structure, to determine the extent of reform. House Bill 2504: GPLET; lease records and reporting, moved through the House Ways and Means Committee this week with amendments that removed any specific rates and inserted blanks. This sent a clear message that legislators want to scrutinize GPLET and work with cities and other stakeholders to craft fair and meaningful reform. The League remains committed to working with Rep. Murphy and others on this effort.

Representative Vic Williams (R - Tucson)

Representative Vic Williams earned a League Champion award in his first term in office, regularly standing up for the rights of cities and towns throughout last year's sessions. A native of California, Mr. Williams has been actively involved in the Republican Party in Arizona since moving here in 2003.
