House Bill (HB) 2212: licensing; accountability; enforcement; exceeding regulation

Overview: HB 2212 allows prohibited acts regarding licensing decisions made by an employee of a political subdivision to be enforced in a private civil action.

League Position: NEUTRAL - The bill as introduced lowers the threshold at which applicants can sue, thus increasing the probability of frivolous lawsuits. The sponsor committed to amend the bill to address these concerns and maintaining this neutral position is contingent upon its official adoption. 

Summary: Current law prohibits municipalities from basing licensing decisions in whole or in part on licensing requirements not specifically authorized by statute, rule, ordinance, or code. This bill expressly states that violating this statute can be enforced by private civil action and requires that the language of this section be printed on license applications. The sponsor agreed to amend the bill to address the League's concerns.
